1. Agreement to Terms

By accessing or using SongList ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

SongList provides a web-based platform for musicians to manage their song repertoires, track practice sessions, and organize musical content. We offer both free and paid subscription tiers.

3. User Accounts

You are responsible for:

  • Maintaining the security of your account
  • All activities that occur under your account
  • Providing accurate and current information
  • Notifying us immediately of any unauthorized access

4. Subscription and Payment

Free Tier: Limited to 3 songs. No payment required.

Pro Tier: $2 per month, billed monthly. Unlimited songs and full access to all features.

Subscriptions automatically renew until canceled. You may cancel at any time through your account settings. No refunds for partial months.

5. Acceptable Use

You agree NOT to:

  • Use the Service for any illegal purpose
  • Violate any laws or regulations
  • Infringe on intellectual property rights of others
  • Upload malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to our systems
  • Harass, abuse, or harm other users
  • Share copyrighted material without proper authorization

6. Your Content

You retain all rights to the content you upload (songs, notes, practice logs). By using the Service, you grant us a limited license to store, display, and process your content solely to provide the Service to you.

You are responsible for ensuring you have the right to upload any content, including sheet music and recordings.

7. Intellectual Property

The Service, including its design, features, and code, is owned by SongList and protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.

8. Termination

We reserve the right to suspend or terminate your account at any time for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Non-payment of subscription fees
  • At our sole discretion with or without cause

You may terminate your account at any time by contacting us or using account deletion features.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not guarantee that the Service will be uninterrupted, error-free, or secure. Use the Service at your own risk.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SONGLIST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, REVENUE, OR PROFITS.

Our total liability for any claims related to the Service is limited to the amount you paid us in the past 12 months (maximum $24).

11. Indemnification

You agree to indemnify and hold harmless SongList from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any rights of others.

12. Data Backup

While we implement backup procedures, you are responsible for maintaining your own backups of important content. We are not responsible for data loss.

13. Changes to Terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms. Material changes will be communicated via email or prominent notice on the Service.

14. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of the jurisdiction where SongList is operated.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
